By using SparkLabs Makerspace facilities, attending events, or accessing member services, you agree to be bound by these Terms of Use. Please read them carefully. If you do not agree to these terms, do not use our facilities or services.

1. Acceptance of Terms
These Terms of Use constitute a legally binding agreement between you and SparkLabs Makerspace (a fiscally sponsored project of the Media, Technology, and Cultural Exchange [MTC] Fund). By accessing or using our facilities, website, or services, you acknowledge that you have read, understood, and agree to be bound by these terms.
2. Membership Terms
Memberships are issued to individuals and are non-transferable. Membership dues are billed monthly or annually as selected at signup. Memberships auto-renew unless cancelled at least 5 days before the next billing date. Refunds are not provided for unused partial months. Annual memberships may be cancelled for a prorated refund within the first 30 days. SparkLabs Makerspace reserves the right to suspend or terminate memberships for violations of these terms or the Code of Conduct.
3. Facility Use
Members and guests must complete required safety orientations before using any equipment. You must use equipment only for its intended purpose and in accordance with posted guidelines and staff instructions. Minors (under 18) must be accompanied by a parent or legal guardian at all times and may not use certain equipment without explicit written permission. SparkLabs Makerspace reserves the right to refuse access to any person at any time for any reason consistent with applicable law.
4. Code of Conduct
All members, guests, and visitors are expected to behave in a respectful, professional manner. Harassment, discrimination, or threatening behavior of any kind will not be tolerated and will result in immediate removal and possible termination of membership. SparkLabs Makerspace is committed to providing a welcoming environment for all people regardless of race, gender, age, disability, religion, national origin, or sexual orientation.
5. Assumption of Risk and Liability Waiver
You acknowledge that use of makerspace equipment and facilities involves inherent risks, including but not limited to personal injury, property damage, and exposure to hazardous materials. You voluntarily assume all such risks. To the maximum extent permitted by law, SparkLabs Makerspace, its officers, directors, employees, and volunteers shall not be liable for any injury, loss, or damage arising from your use of the facilities or equipment. A separate liability waiver may be required for certain activities or equipment.
6. Intellectual Property
You retain ownership of any projects or works you create at SparkLabs Makerspace. By using our facilities, you grant SparkLabs Makerspace a non-exclusive, royalty-free license to photograph or document your projects for promotional purposes, unless you opt out in writing. SparkLabs Makerspace's name, logo, and branding are proprietary and may not be used without written permission.
7. Personal Property
SparkLabs Makerspace is not responsible for lost, stolen, or damaged personal property. Members store property at their own risk. Items left unattended for more than 7 days without prior arrangement may be disposed of or donated.
8. Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information.
9. Changes to These Terms
SparkLabs Makerspace reserves the right to modify these Terms of Use at any time. We will provide notice of material changes by posting updated terms on our website and, where appropriate, notifying members by email. Your continued use of our facilities or services after any such changes constitutes your acceptance of the new terms.
10. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Pennsylvania.
